The noirlab.ca website and NOIR LAB online store are operated by Lauradex Inc., the owner and operator of the NOIR LAB brand.

These Terms of Use govern your access to and use of our website and purchases made directly from NOIR LAB.

By using our website or making a purchase, you agree to be subject to these Terms of Use and the applicable policies, including our Privacy Policy, Refund Policy and Shipping Policy.

Nothing in these Terms limits any mandatory consumer rights available under applicable law.

Our online store uses the e-commerce platform provided by Shopify.

Unless otherwise stated, sales made through noirlab.ca are between the customer and Lauradex Inc.

All products are subject to availability.

Adding a product to your cart does not reserve inventory.

In the exceptional event that a product becomes unavailable after an order is submitted, we will contact you and provide an appropriate solution, including a refund where required.

When you submit an order, you are submitting a request to purchase the selected products based on the information displayed at the time of the transaction.

Before confirming your order, you are responsible for reviewing the products, quantities, contact information, shipping address and other information provided.

Where NOIR LAB cancels a paid order, any amounts that must be refunded will be returned in accordance with applicable law.

Applicable taxes and, where relevant, shipping charges are disclosed before completion of the purchase in accordance with applicable requirements.

Available payment methods are displayed at checkout.

Payments may be processed by Shopify and other authorized payment service providers.

You represent that you are authorized to use the payment method provided for your order.

NOIR LAB does not necessarily have direct access to or retain complete payment card information.

 

9. Shipping and Delivery

Available shipping options, charges and delivery estimates are displayed on our website or at checkout.

Delivery times are estimates and may vary due to circumstances such as order volumes, weather conditions or carrier operations.

We take reasonable measures to deliver orders in accordance with the information provided at the time of purchase.

Any rights available to consumers where delivery does not occur within the time required by applicable law remain fully effective.

Risk of loss or damage is allocated in accordance with applicable law, and nothing in these Terms transfers to the customer any risk that legally remains with NOIR LAB.

10. Returns, Exchanges and Refunds

Returns and refunds are governed by our Refund Policy.

In general, eligible products that remain unopened, unused, unsprayed and in their original intact packaging may be returned within the period specified in that policy.

Due to the nature of fragrance products and for hygiene reasons, opened, sprayed or used products generally cannot be returned solely because of a change of mind.

These restrictions do not limit rights that apply where a product is defective, damaged, incorrect or where applicable law provides otherwise.

 

11. Legal Warranties

Products sold by NOIR LAB are covered by warranties and protections provided under applicable law.

In Quebec, these protections include legal warranties relating to normal use, reasonable durability, conformity with representations made regarding the product and latent defects.

Nothing in these Terms, our Refund Policy or any other NOIR LAB policy excludes, restricts or replaces a legal warranty that cannot lawfully be excluded by contract.

 

12. Intellectual Property

Unless otherwise indicated, website content, including text, photographs, images, illustrations, graphics, videos, logos, product descriptions, designs and layouts, is owned by Lauradex Inc. or used with the necessary rights or authorizations.

NOIR LAB is a brand operated by Lauradex Inc.

Website content may not be reproduced, distributed, modified, published or commercially exploited without prior authorization, except where permitted by applicable law.

Third-party trademarks remain the property of their respective owners.

 

13. Comments, Reviews and Submitted Content

If you voluntarily submit a comment, suggestion, photograph, review or other content, you represent that you have the right to submit it.

You retain any rights you hold in your content.

Nothing in these Terms restricts a consumer's right to publish a legitimate review regarding NOIR LAB or its products.

NOIR LAB uses Shopify as its e-commerce technology platform.

Shopify provides services including hosting, store functionality, payment-related services and certain data processing services.

Purchases of NOIR LAB products made directly through noirlab.ca are nevertheless made from Lauradex Inc., not Shopify, unless expressly stated otherwise.

16. Accuracy of Information and Errors

We take reasonable measures to ensure that information displayed on our website is accurate.

Pricing, description, availability or other errors may nevertheless occur.

We may correct errors or update information where necessary.

Where an error affects an order that has already been placed, we will address the matter in accordance with applicable law and contact the customer where appropriate.

A French version of these Terms is available and remains accessible.

A translation may also be made available in another language.
